These are the Terms and Conditions for all bids offered by Blitz Zimbabwe, which shall hereafter be referred to as “Blitz”.

The purpose of these Terms and Conditions is to record and explain the Terms and Conditions under which all bids are offered and accepted by Blitz.  These Terms and Conditions apply to all transactions between you and Blitz. Blitz shall not be bound by any express or implied term, representation, warranty, promise, or the like not recorded herein.

Any bid offered and accepted by Blitz is accordingly subject to these Terms and Conditions. It is your responsibility to ensure that you are fully acquainted and familiar with them, as well as the relevant national legislation.
These Terms and Conditions may be changed from time to time by Blitz and it is your responsibility to ensure that you are acquainted and familiar with any such changes.

No failure on the part of Blitz to exercise, and no delay by Blitz in exercising, any right under and in terms of these Terms and Conditions will operate as a waiver of that right, nor will any single or partial exercise of any right under these Terms and Conditions preclude any further or other exercise of that right nor act to the exclusion of any other right.

Should Blitz fail or decline to enforce the whole or part of these Terms and Conditions or grant any indulgence to you, then that act or omission shall not be interpreted as a waiver of rights, nor shall it act as a way to contradict these terms or otherwise prejudice Blitz.

The customer accepts that it is their responsibility to be aware of the General Terms and Conditions relating to bidding as contained in the relevant Act, as well as to be aware of Blitz’s unique polices regarding bidding.
All bids taken must be accompanied by a full ZASH payment, and we do not accept credits or cheques for any transactions.
Blitz may at any time withdraw the goods on offer for bidding at any given time.

Blitz reserves the right to adjust the prices offered on the site at any time.

 All winning bids will be delivered within a period of 30 days.

The minimum age to place a bid with Blitz is 18 years. 

Blitz aims to maintain a friendly business relationship with all our customers. Blitz does, however, reserve the right to refuse to accept a bid from you and to suspend or close any account if you refuse or fail to comply with these Terms and Conditions.

In the event that Blitz suspects fraudulent activity in relation to any bid, Blitz reserves the right to suspend the account and the processing of any and all transactions on that account until Blitz is satisfied that the transactions concerned are lawful. Blitz will report any fraudulent activities to the relevant authority. Persons attempting fraud will be prosecuted and any bids fraudulently placed with Blitz will be void.

Only bids that were placed using a fully verified ZASH account will be accepted on Blitz. Payments made from an account that is not fully verified will not be considered a valid bid.

Blitz will treat your bids and winnings as confidential and will not disclose any information in connection with your transactions to a third party unless and to the extent that it is obliged by law to do so.

It is your responsibility to advise Blitz of any changes of address or contact details.

Blitz and its directors, employees, agents, and shareholders accept no responsibility or liability for any damages or loss that may result, or be alleged to have resulted, from Blitz’s bidding platforms or its contents, including interruptions in transmission or operation, loss of or corruption of data, failure of lines or any other communication medium, any individual misuse of the site or its content, or any error or omission in content.

• You agree to access and use the Blitz platforms only for lawful reasons. You are responsible for knowing and complying with any and all laws, statutes, rules, and regulations pertaining to your use of these bidding platforms. You are prohibited from using these bidding platforms in any way that:
  
• is threatening, violent, abusive, hateful, defamatory, slanderous, libelous, deceptive, fraudulent, tortuous, indecent, vulgar, profane, obscene, or that Blitz deems in its sole discretion to be inappropriate for these Blitz platforms;
• violates any law, regulation, or court order;
• accesses, collects or stores personal information about others;
  violates or infringes upon the rights of anyone else, including, for example, another person’s right to privacy;
• impersonates any person, business, entity, or IP address (e.g., IP spoofing);
• involves uploading, posting, e-mailing, transmitting or otherwise making available any materials that you do not have a right to make available under any law;
• is commercial in nature, including, for example, advertising, promotional or marketing materials, or spam, phishing, or other unsolicited messages;
• gains or tries to gain unauthorised access to these Blitz platforms, its computers and networks, or its user data, or that otherwise modifies or interferes with the use or operation of these Blitz platforms;
• alters, damages, or deletes any content posted on these Blitz platforms;
• contains or introduces computer viruses or other disruptive, damaging, or harmful files or programs; or
• otherwise violates these General Terms and Conditions or any other guidelines or policies posted on these Blitz platforms.

Although Blitz and its proprietors make every effort to keep information hosted on the website accurate and current as well as in accordance with guidelines and legislation, we cannot be held responsible for:

• liability for any damages;
• side effects;
• adverse effects;
• medical complications;
• injury;
• addictions; or
• death arising from the use of any
• information available on its website.
  

Blitz is not responsible for the content of linked third party platforms or the services offered therein, does not make any representations regarding the content or accuracy of materials on such third party platforms, and will accept no liability for any direct or indirect damages arising out of your access and use of the information provided therein.

• Terminate Use
  Blitz reserves the right to terminate, suspend, or cancel any bids or bidding accounts, suspected fraud of any type, any attempt to lay Account bidding bids by persons under the age of 18 years old, and for violations of any applicable rules, regulations, or state laws.

• Inquiries
  By registering for and using a ZASH account to bid on Blitz, you acknowledge and agree that we may make any inquiries that we consider necessary, either directly or through third parties, concerning your identity.

• Payment Limitations
  In order to prevent financial loss to you or to us, such as if we suspect a data breach or that an unauthorised person may have accessed your bidding account, we may place a delay on a payment for a period of time, or limit payment methods for a transaction, or limit your ability to make a purchase, or deactivate your account. Blitz reserves the right to scrutinise and verify all winnings before delivery.
• Sharing of Information
  We may contact your financial service provider, law enforcement, or affected third parties (including other users), and share details of any payments or transactions associated with your bidding account, if we believe doing so may prevent financial loss or a violation of law.

• Right to Refuse/Limit Bids
  Blitz is not obliged to accept any bid or type of bid. Accordingly, Blitz reserves the right to refuse the whole or part of any bid without offering any explanation. 
• Correction of Errors
  Blitz reserves the right to correct any errors on Blitz’s website at any time by substituting the correct information as determined by Blitz, in its sole discretion in respect of the event concerned, for the original Blitz price, regardless of whether or not the bid has been struck, in which event you will be deemed to have been offered and, where applicable, accepted accordingly the bid to have been struck at the corrected odds.

  Blitz reserves the right to correct results where they have been previously incorrectly processed and paid. Blitz accounts which have been incorrectly credited with incorrect winnings as a result will be adjusted to reflect the corrected position or where customers are incorrectly paid in cash with incorrect winnings, then the incorrect winnings will be corrected by the Blitz team, and users hereby authorise Blitz to do so and also waive any and all claim which they may have against Blitz for delivery of any prize incorrectly awarded to persons.

  Please check your bids before the end of the bidding period. Cancellations and amendments cannot be made once a bidding event has ended, so refunds cannot be given. Please note that once an event has ended, that event is locked and cannot thereafter be activated. It is your responsibility to check that your bid is correct immediately after processing.
  If you provide us with the incorrect contact information, any winnings will be awarded to parties at the contact details you provide.

For a bid to be accepted by Blitz, it must be a valid bid. A valid bid:

1. is one which has been offered by Blitz;
2. is placed from a fully verified ZASH account via website or mobile app;
3. is placed by a person of 18 years or older;
4. is not fraudulent;
5. is not a credit bid;
6. has been placed with Blitz using any one of the prescribed methods used by Blitz; and
7. is not a void bid as may be determined elsewhere in the Terms and Conditions.

   Blitz shall not be obliged to accept a bid or pay prizes in respect of a bid that is not a valid bid.
   If you have any doubts as to whether a bid has been accepted and is accordingly valid you should check with the Blitz support desk.
   

You must sign-up for a ZASH account in order to bid. The amount of account bids per day you are permitted to place is subject to limitations established by Blitz.

It is your responsibility to ensure that the details of all bids are correct.  If you dispute the nature, type, and odds in respect of any bid, Blitz’s transaction log database will be final and binding in determining the outcome of that dispute.

You are solely responsible for the security and the confidentiality of your ZASH account.

Customers can only bid up to the amount held within their ZASH account. No credit bids will be accepted by Blitz.

• In particular, you agree to keep your username, password and/or PIN strictly confidential and you are responsible for any misuse of your password and/or PIN.
• Provided that we have been correctly supplied with the account information requested, we are entitled to assume that offers and payments are made by you.
• You undertake to protect your username and password in the same way that you would in respect of your bank cards and any failure to do so shall be at your sole risk and expense.
• If another person accesses your account, you are solely responsible for all their actions whether or not their access was authorised by you and you hereby indemnify us and hold us harmless against all costs, claims, expenses, and damages howsoever arising in connection with the use of or access to your account by any third party.

  A bid placed with Blitz by SMS, fax, or any other medium not prescribed and identified within these Terms and Conditions will not be accepted by Blitz and will be void.
  

Bids are settled according to the odds/price displayed at the time the bid is accepted by Blitz. Bids may be subjected to the relevant run/deduction applicable to that particular bid.
Should winnings be credited to your account in error, it is your responsibility to immediately notify Blitz of the error.  Any winnings given to you as a result of the error and prior to the notification of Blitz, whether linked to the error or not, shall be deemed to be invalid and will be repayable by you to Blitz and you are deemed to agree and accordingly hereby authorise Blitz to take the necessary steps to recover the winnings erroneously given to you.

In order to prevent loss to you or to us, such as if we suspect a data breach or that an unauthorised person may have accessed your bidding Account, we may place a delay on delivery of prizes for a period of time, or limit delivery for a transaction. Blitz reserves the right to scrutinise and verify all winnings before delivery.

By bidding on Blitz, you agree that we may communicate with you electronically to deliver any important information regarding your bids or your account. We may also provide notices to you by posting them on our bidding platform, or by sending them to an email address or street address that you previously provided to us. Blitz platforms and e-mail notices shall be considered received by you within 24 hours of the time posted or sent.

Blitz reserves the right in its sole discretion to deem any bid that does not comply with these terms and conditions as void.
 In the event of a void bid, the bid will be declared void and Blitz will return all bids placed; all bids paid under a void bid will be refunded to the person who had their bid voided.

Blitz reserves the right to suspend a bidding market at any time.  When a market is suspended, any bids placed during that suspension will be rejected and any bid accepted will be void. 

Deliveries or collections must be done within 30 days of conclusion of the winning bid.

It is compulsory that your full names, residential address, and contact details are obtained by Blitz to comply with appropriate regulations.

By using the bidding facilities on the Blitz platforms, you acknowledge there is a risk of losing money and/or ZASH and you accept full responsibility for such losses.

You acknowledge and agree that your access to, and use of the products and bidding facilities offered via the website, is at your sole option, discretion, and risk.

Under no circumstances will Blitz be liable to you in contract, breach of statutory duty or otherwise, under or in connection with these terms, your use of, or inability to use, the website, or other products or services, or any of our chat rooms, for:

1. any injury, loss, claim, loss of profits, opportunity or revenue, loss of business or agreements, loss of goodwill, loss of use or corruption of software, loss or corruption of data, or loss of anticipated savings;
2. loss or damage to property, or injury; or

general damages or any direct, indirect, special, incidental, consequential, exemplary, or punitive damages of any kind.

You specifically acknowledge, agree, and accept that Blitz is not liable for the following:

1. the accuracy and completeness of any information services provided, including without limitation prices, times, results, or general information on the goods placed for bidding on the Blitz website;
2. acts or omissions by a third party whom you have authorised to gain access to Blitz’s bidding platform on your behalf;
3. any link contained, or the website or content contained, on any internet sites linked to and from the website;
4. IT failures which are caused by the hardware or software equipment which you are using to access the Blitz’s bidding website;
5. any defamatory, offensive, or illegal conduct of any customer or third party;
6. any loss, including any loss of winnings, arising from the use, abuse, or misuse of your account or any of Blitz’s products and services, whether by you or a third party acting on your behalf;
7. any loss, including loss of winnings, incurred in the sending of information to our website by you or by a third party acting on your behalf; or
8. any technical failures, system breakdowns, defects, delays, interruptions, manipulated or improper data transmission, loss or corruption of data, communications’ lines failure, distributed denial of service attacks, or bugs or viruses or any other adverse technological consequence to bidding facilities on the Blitz website.

   Blitz reserves the right to close any bid, whether it be a result of more than one bidding account opened by you, or malicious use and bid placement on your behalf. Blitz also reserves the right to refuse any pending bid it finds malicious.
   You acknowledge and agree that all trademarks, logos, domain names, database rights, and all related software, including content published or used on the website, is the intellectual property of Blitz.
